Man Faces Murder Trial

46-Year-old Kabba Dumbuya, a motor mechanic and a business man has made his first appearance before Magistrate Santigie Bangura of Pademba Road Court No.2 in Freetown on two count charges which are Murder and Incitement contrary to law.

According to the particulars of offence on 13th October 2023 at Finnah Drive, Off Benguema Road Waterloo, Western Rural Area of Freetown Murder Samuel Turay.

On court two on the above-mentioned date and place, the accused person unlawfully conducted himself in a violent manner thereby creating a scene and breached the peace against the family members of Farrah Turay that resulted to an unlawful killing of his young brother Samuel Turay.

The charge was read and explained to the accused and no plea was submitted.

Sergeant 9155 Dwight Macarthy lead prosecution witness No. 2. Explained that Farrah Turay a Military Officer 1882282 attached at the Joint Logistics Unit Murray recognised PW 1 as her mother and the deceased as his younger brother.

That PW 1 recognised the accused as his neighborhood friend and recalled that on the 13th and 14th October 2023 something transpired between herself, the accused person and the deceased.

That on the above date, his mother called him and told him that the District Council had demolished structures that his father was putting up.

He said that he left his duty and went to the scene by then, the road was blocked by his father, but he proceeded to the scene and took his family members inside the house.

He said that the accused person and other people hit him with a stick on his side, before he spotted his brother, the deceased coming to the scene.

That the accused person, his wife and other people hit the deceased with sticks.

He testified that he went to the Waterloo Police Station and that while he was at the station, he saw the deceased being brought to the station together with one John.

He said that the Police issued a medical request form to him, and he went to the community hospital while the deceased was taken at the Connaught Hospital for medical care but that on the following day, he received a call that his brother had passed away.

The medical report was tendered in court and recorded as evidence.

PW 3, Timothy Turay, a pensioner recognised PW 1 as his wife and the deceased as his son, and the accused person as his neighbor and recalled on the above date that his structure was demolished.

That he reported the matter to the police station and the police came and took pictures of the scene at around 7:00 pm.

He said that the accused came and scattered the barricade and said blood would be shed and that there is going to be killing.

He testified that his wife, PW1 called one John Turay as witness as the accused person started confrontation but that the accused took sticks and hit John who came to advise him, and he started hitting the deceased on his head.

The deceased collapsed and the wife and relatives of the accused person rushed and continue to beat the deceased all over his body.

He said the deceased was taken to the Connaught Hospital and was later told that his son is dead.
He said that he witnessed the postmortem that was done at the Mortuary and the result was tendered in court as part of the evidence.

He said that the deceased have been buried.

Magistrate Santigie Bangura refused bail and remanded the accused person to the Male Correctional Facility in Freetown.

The matter was adjourned to 2nd February 2024.
