A business tycoon Abdul Kakpa has been dragged to court for allegedly killing his girlfriend by beating her to death.
Accused Abdul Kakpa was standing in court before Magistrate Santigie Bangura of Pademba Road Court No.1 on one court charge of murder contrary to Section 1 of the offense against the Person’s Act of 1861.
“The prosecution is taking a line of action and that line of action is in the best interest of justice as it will enhance speedy trial for the wind of Justice to role in a manner everybody will be satisfied,” Counsel Isaac Y. Sesay stated on Wednesday 4th September 2024 before Magistrate Satingie Bangura.
Counsel Sesay further asked for an adjournment date in order to well inform the line of action and to ensure that justice prevail in the matter.
One of the defences counsel, Julian Cole representing the accused (Abdul Kpaka) objected that the prosecution team were in court the last time when the state counsel said they will lead vocally adding that it’s okay for them to have commenced proceedings on the matter adding that the accused person’s liberty is at stake, and that they were hoping that the court could have looked into the matter for Justice to be done.

He mentioned that the state should have taken a prosecution witness by now and also had a week to communicate the same to them.
Julian Cole and the other defence counsel opposed the application made by the state counsel, and argued that the court proceeding should be expeditious and submitted that the prosecution is legally obliged to make progress with the proceeding as the prosecution were the one who charged the matter to court.
He furthered that this it is the second time the state counsel has requested for an adjournment date hoping that they will make progress, but “Justice delay is Justice denied,” he said.
“Having heard all what you have said from both the defence and the state counsel the court cannot press the first proceedings to move on with their case, whereas the prosecution is not yet ready to proceed with their case, noting that the defence have objected to that direction, I accord the prosecution one more opportunity to adjourn,” Magistrate Santigie Bangura stated.
Meanwhile the matter was adjourned to the 9th September 2024.
