Former APC Ministers Association Calls For Immediate Establishment of Lawful, Neutral And Time-Bound Interim Executive Of APC

The Former APC Ministers Association (FORMINA) notes with serious concern the expiration of the prescribed term of office of the National Executive of the All-People’s Congress (APC) and the continued delay in establishing an appropriate transitional arrangement.
FORMINA maintains that respect for the APC Constitution and the rule of law must remain paramount. An expired mandate should not be extended by administrative convenience or inaction.
Accordingly, FORMINA calls for the immediate establishment of a lawful, neutral and time-bound interim administration whose principal responsibility should be to conclude all outstanding Party processes and facilitate the convening of a National Delegates’ Conference for the election and assumption of office of a new National Executive. This will adhere to section 39(5) of the PPRC Act of 2022, which stipulates that a political party shall not extend the tenure of any of its executives for more than six months.
FORMINA further calls upon the Party’s Legal Advisers to urgently issue a considered legal opinion clarifying the constitutional status of the outgoing leadership and recommending the appropriate mechanism for establishing an interim administration and completing the transition.
FORMINA reminds the outgoing leadership to refrain from upholding authority contrary to Articles 5 and 52(a,b) of the party’s constitution, which underscored the primacy of the APC Constitution and the executive’s three-year mandate. Should the current situation continue, some APC members have already threatened to pursue appropriate legal actions to safeguard both the Constitution and the party’s democratic
integrity. This development will erode the party’s cohesion and readiness.
FORMINA believes this matter should preferably be resolved internally, responsibly and without unnecessary litigation. We urge Comrade Alie Suma, the APC district chairman of Port Loko, to drop his legal action against the APC party and PPRC.
We call on all stakeholders of the party to act promptly in the overriding interest of the APC. The Party must remain above individuals, and constitutionalism must prevail over political convenience
