Justice Alhaji Momoh Jah Stevens has sentenced one, Aruna Aliaji Fofanah to Five (5) years imprisonment for sexually penetrating a child below the age of Eighteen (18).

Prior to the sentencing, the convict was before the court on one count of sexual penetration contrary to Section 12 of the Sexual Offence Act, 2012.

The indictment stated that the convict on 12th March, 2019, at Rokel, Western Area Rural had sexual intercourse with a ten-year-old child.

Before sentencing the convict, Justice Momoh Jah Stevens said the prosecution lined up three witnesses including the victim and police officers.

He said the victim told the court that, she was in the house when the convict called her inside the kitchen and asked her to undress herself, she said after she has undressed the convict sexually penetrated her, the victim said that she went and told her aunt about what the accused has done to her and the aunt warned her not to disclose what has happened between him and the convict to anybody, the mother of the victim took the victim to the police station and reported the matter.

Justice Stevens said that the medical report showed that the hymen of the victim has been raptured.

“I am satisfied that the prosecution has proven their case beyond all reasonable doubt against the convict,” he stated.

Justice Momoh Jah Stevens said based on the evidence before him and in the court, the accused is guilty of the offence of sexual penetration.

Defense counsel representing the convict, A Sesay made a plea of mitigation on behalf of the convict that he was very remorseful and had learnt his lesson.

He submitted that the convict just rose out of minor and he is a school going pupil that has brighter future

He pleaded with the judge to temper justice with mercy on the convict and pleaded with him not to impose a long-term sentence on the convict.

But Justice Momoh Jah Stevens sentenced him to five years imprisonment to be served in full.
